DSI accepted the case of trespass, unlawful issuance of title deeds in the area of watershed forest in Chiang Khan Subdistrict, Chiang Klang District, Nan Province by a group of capitalists as its special case no.105/2563

 

 

       After obtaining a complaint requesting for fact finding inspection in the case of trespasses on the watershed forest in the area above the Nam Liab Reservoir, Ban Don Thaen, Chiang Khan Subdistrict, Chaiang Klang District, Nan Province by a group of capitalists, politicians and government officials occupying, possessing, reclaiming and squatting on land by unlawful issuance of the title deeds, the Director-General, Pol.Lt.Col. Korrawat Panprapakorn ordered to investigate this case. The preliminary investigation revealed that there are 8 plots of land comprising the title deed nos.9373, 9374, 9375, 9376, 9383, 9389, 9388 and 9356 in Chiang Khan Subdistrict, Chiang Klang District, Nan Province covering the area about 250 rai. These title deeds might be issued illegally because they cover the mountain area full of pebbles with a ridge but without utilization.

       Furthermore, the inspection revealed the issuance of 50 title deeds, covering the area of land about 1,150 rai, of nearby plots likely to be issued illegally due to the same mountain area and no land utilization. It covers the area of land about 1,400 rai in total.

 

 

       The Director-General opined that the acts of the person issuing land title deeds and naming as the possessor of the said 58 plots of land are regarded as the acts of occupation and possession of state lands or forestry areas by employing the issuance of title deeds as their tool for occupying the said lands. It is also a criminal offence pursuant to Section 9 and Section 108 bis of the Code of Land, Section 54 and Section 72 ter paragraph two of the Forest Act, B.E. 2484 (1941) and Section 83 of the Criminal Code. The aforesaid act is a criminal offence that is complex and cause serious effects upon public order and moral and national security, which its nature is regarded as the criminal offence pursuant to Section 21 paragraph one (1) (Gor) and (Kor) of the Special Case Investigation Act, B.E.2547 (2004), and its amendment. Therefore, the Director-General ordered to accept this case as a special case pursuant to Section 21 paragraph one (1) and to inquire by the Bureau of Natural Resources and Environment Crime.
